Terms and Conditions

These terms and conditions form part of the contract between Dryflyfishing Limited and the booking party.

The booking party shall be deemed to include all members of that fishing party and taken together collectively shall be known as ‘the Client’.

Bookings shall be taken on a named per rod basis.  A rod shall be deemed to include one person only.  At the point of booking the booking party shall confirm with Dryflyfishing Limited the number of rods within a party that together constitute the Client.

Rods are non-transferrable and relay fishing/rod sharing is not allowed.

Confirmation of the booking is taken as agreement to the terms set out herein and shall also be taken as confirmation that the Client has read, understood and agreed to the contents of the risk assessment.

BOOKING 
Bookings must be made direct to Dryflyfishing Limited, or via an agent.  Bookings must made be by either email or in writing only.

Once a booking has been accepted an invoice shall be provided to the Client detailing the booking.

Once a booking has been accepted you will be provided with full details of our booking procedure.

PAYMENT
Once an invoice has been provided to the Client, terms of payment shall be within 30 days of the date of the invoice. We reserve the right to charge interest at a rate of 8% per annum above the Bank of England base rate on all overdue accounts.

PRICES
The price of the booking shall be stated on the invoice.

We reserve the right to amend our prices at any time before a booking is taken.

Once a booking has been confirmed in writing by Dryflyfishing Limited the price of the booking is guaranteed and will not change.

DESCRIPTION
Whilst Dryflyfishing Limited takes all reasonable care to ensure that all the details shown in our advertising are correct we cannot accept liability if the facilities pictured and/or described are altered or withdrawn without our knowledge and beyond our control.

Should facilities and/or the services offered at the time of the booking subsequently alter because of circumstances beyond our control we shall draw these changes to the notice of the Client as soon as reasonably practicable.

CANCELLATION BY THE CLIENT
In the event of cancellation by the Client, for whatever reason, the following scale of charges shall be payable:

Cancellation prior to 90 working days before the booking: 50% of total cost.

Cancellation between 0-89 working days before the booking: 100% of total cost.

However, in any event, Dryflyfishing Limited shall make every effort to re-let the booking and in such an event 50% of the total cost will be refunded to the Client.

GIFT VOUCHERS
These are non-refundable and non-transferable. Gift vouchers are valid for two years from the date of purchase.

CANCELLATION OF GIFT VOUCHERS
The original purchaser may cancel a voucher for a full refund within 14 days of purchase.

ALTERATIONS TO CONFIRMED BOOKINGS
If you decide to change any part of your booking after these have been confirmed up to 90 days prior to arrival, we will try to assist at an administration charge of £50 per alteration, plus any additional reasonable costs incurred.  Changes or alterations within 90 days of the booking will be treated as a cancellation and cancellation charges will apply.

CANCELLATION BY DRYFLYFISHING LIMITED
We reserve the right to cancel any booking due to unforeseen circumstances.  In such a case we will offer an alternative booking of similar value or a full refund of all monies received by us for that booking.

CURTAILMENTS AND LIABILITY
Neither Dryflyfishing Limited nor any person assisting it shall be liable for the consequences of delays or restrictions arising from adverse weather, obstructions, repairs or damage to navigational works, flooding, shortage of water, industrial action, fuel rationing, shortages of or non-availability of fuel or any other cause beyond our control.

Dryflyfishing Limited reserves the right to restrict the activity if unusual or hazardous conditions prevail.

Neither Dryflyfishing Limited nor any person or company assisting or collaborating with it shall be held liable for loss or damage to personal belongings of the Client howsoever arising.

As with all activities associated with water, the Client in making the booking accepts the risk inherent in fishing and agrees to take responsibility for each rod’s (and any non-fishing guests’) safety whilst engaging in the activity. Each rod agrees to abide by reasonable instructions made by Dryflyfishing Limited and its associates when made to ensure compliance with safety in and around the water.

HEALTH AND SAFETY
We urge all who fish to wear protective eyewear to prevent accidents. Our experience is that insurance companies will not cover anyone who has not worn protective eyewear. The Client should make suitable provision for their own medical needs.

Each fishery has its own rules and regulations governing the handling, taking and returning of fish, the conduct expected both on the river bank and in huts provided for guests’ use, the removal of refuse, parking, safety, hours of fishing and other provisions. The Client should read these conditions and abide by them. Most of our fishing is up-stream dry fly and later in the season, up-stream nymph only.

Dryflyfishing Limited Guides/Instructors work from 10am until 6pm. If you require their services outside these hours then that is by negotiation and we would ask that you reward the Guide for additional hours in addition to any gratuity that you would normally offer. Our guide price does not include flies, leaders and statutory national rod licence.

All Guides / instructors must be hired through Dryflyfishing Ltd. Freelance fishing guides are not allowed on our waters.

Please ensure the Client and all members of the Client party have read the risk assessment.

EQUIPMENT OR GOODS SOLD/HIRED BY DRYFLYFISHING LTD
Risk in the goods will pass to you on delivery. Ownership of goods supplied shall remain vested in Dryflyfishing Limited and shall not pass to you until payment in full for all such items has been made.

Equipment supplied during the day at the Client’s request will be billed to the same billing address and to the same person as the invoice for the booking.

HIRED EQUIPMENT
All equipment hired by the Client is covered by insurance for malfunction or accidental breakage. Any equipment not returned at the end of the day will be billed at retail price.

INSURANCE BY THE CLIENT
Whilst Dryflyfishing Limited takes all reasonable care to ensure the booking goes ahead, circumstances beyond our control, such as cancelled travel arrangements, illness and changes in Government restrictions may adversely affect the booking.

To protect against such circumstances Dryflyfishing Limited strongly advises the Client to take out separate insurance to cover any losses arising from travel disruption and/or the need for cancellation of the booking.

Dryflyfishing Limited cannot accept liability for losses arising from such unforeseen circumstances.

Jurisdiction
Your contract with Dryflyfishing Limited is governed by English Law and any dispute is to be settled in the English Courts.
